Artist Terms & Condition

These Artist Terms apply to any artist whose music, merchandise, or event tickets are displayed or sold on Soundfiti.
 

By submitting content or approving an artist page on Soundfiti, you agree to these Terms.

1. About Soundfiti

Soundfiti is a digital marketplace that enables artists to showcase and sell music, merchandise, and event tickets directly to fans through dedicated artist pages.

Soundfiti operates as a technology, marketing, and payment facilitation platform, not as a record label, manager, distributor, or event organizer.

 

2. Artist Eligibity

  • Artists must be 18 years or older or legally authorized to sell creative works.

  • Artists must provide accurate identity and contact details.

  • Soundfiti may verify artist information to comply with Kenyan law and prevent fraud.

 

3. OWNERSHIP & RIGHTS

3.1 Artist Ownership

Artists retain full ownership of all music, artwork, merchandise designs, and event-related content.

3.2 License to Soundfiti

Artists grant Soundfiti a non-exclusive, royalty-free, worldwide license to host, display, promote, market, and sell their content on the platform.

 

4. CONTENT RESPONSIBILITY & COPYRIGHT

Artists confirm they own or control all rights to their content and that it complies with the Kenya Copyright Act, 2001.
Artists agree to indemnify Soundfiti against any claims arising from copyright infringement or ownership disputes.

5. PLATFORM FEES, MARKETING FEES & PAYOUTS

All fees are deducted before artist payouts.

 

5.1 Music Sales

For all digital music sales:

  • 20% Platform Fee retained by Soundfiti.

  • 20% Marketing & Promotion Fee retained by Soundfiti.

  • 60% paid to the Artist.

 

5.2 Merchandise Sales

a) Soundfiti-Fulfilled Merchandise

  • 25% retained by Soundfiti as platform and fulfillment fee.

  • 75% paid to the Artist.

b) Artist-Fulfilled Merchandise

  • 15% retained by Soundfiti as platform fee.

  • 85% paid to the Artist.

 

5.3 Event Ticket Sales

  • 15% of total ticket sales retained by Soundfiti.

  • 85% paid to the Artist or Event Organizer.

 

5.4 Payout Schedule

  • Artists may request withdrawal of available earnings.

  • Payouts are settled within 2–3 business days after a valid withdrawal request is submitted, subject to payment provider processing times.

  • Soundfiti is not responsible for delays caused by third-party payment services or incorrect payout details provided by the artist.

 

5.5 Taxes

Artists are responsible for declaring and paying applicable taxes under Kenya Revenue Authority (KRA) regulations. Soundfiti may withhold taxes where legally required.

6. MERCHANDISE & EVENTS RESPONSIBILITY

Artists are responsible for accurate product descriptions, merchandise fulfillment (where applicable), and event organization.
Event changes or cancellations must be communicated promptly.

 

7. PROHIBITED CONTENT

Artists may not sell content that is illegal, fraudulent, misleading, or infringes intellectual property rights.

Soundfiti may remove content or suspend sales to comply with Kenyan law.

8. REMOVAL & TERMINATION

Soundfiti reserves the right to remove artist pages, content, or suspend payouts where violations or legal risks arise.

9. LIMITATION OF LIABILITY

Soundfiti is not liable for loss of income, reputational damage, or disputes between artists and fans. Services are provided “as is.”

10. GOVERNING LAW

These Terms are governed by the laws of the Republic of Kenya, and disputes shall be resolved in Kenyan courts.

1. ABOUT SOUNDFITI

Soundfiti is an online platform that allows fans to support artists by purchasing music, merchandise, and event tickets directly from artist pages. Soundfiti facilitates payments and access but does not create or own artist content.

2. PURCHASES & PAYMENTS

  • All prices are clearly displayed before checkout.

  • Payments are processed through licensed third-party payment providers available in Kenya.

  • Soundfiti does not store full payment card or mobile money details.

 

3. DIGITAL MUSIC PURCHASES

  • Digital music purchases are for personal use only.

  • You may not copy, resell, distribute, or upload purchased music to other platforms.

  • All digital music sales are final once access or download is provided.

 

4. MERCHANDISE PURCHASES

  • Merchandise is sold by the artist and may be fulfilled either by the artist or by Soundfiti, as stated on the artist page.

  • Delivery timelines, sizes, and product quality depend on the fulfillment method.

  • Refunds, exchanges, or replacements depend on the artist’s stated policy.

 

Soundfiti may assist with communication but does not guarantee refunds.

 

5. EVENT TICKETS

  • Event tickets are sold by artists or event organizers.

  • Tickets are non-refundable unless the event is cancelled or postponed.

  • Entry conditions, security checks, and age limits are determined by the event organizer or venue.

 

Soundfiti is not responsible for venue operations or security arrangements.

 

6. CANCELLATIONS & CHANGES

  • If an event is cancelled or postponed, the artist or organizer will communicate next steps.

  • Refunds or rescheduling are subject to the organizer’s policy.

  • Soundfiti is not liable for costs such as travel or accommodation.

 

7. USER CONDUCT

You agree not to:

  • Engage in fraud or misuse the platform.

  • Abuse artists or misrepresent purchases.

  • Use Soundfiti for unlawful purposes under Kenyan law.

 

8. LIMITATION OF LIABILITY

Soundfiti is not liable for:

  • Artist fulfillment delays or failures.

  • Event changes or cancellations.

  • Losses caused by third-party payment providers.

All services are provided “as is.”

 

9. GOVERNING LAW

These Terms are governed by the laws of the Republic of Kenya, including applicable consumer protection legislation.
